Welcome to Treeboat!

These terms and conditions (“Terms”) form a binding agreement between Inserve India (“we”, “us” or “our”), which operates the Treeboat Platform (as defined below), and any natural or legal person who accesses and/or uses the Treeboat Platform in any manner (“you” or “your”) or utilizes any current or future service, functionality, or offer provided on the Treeboat Platform (“Service(s)”), as updated from time to time.

By using the Treeboat Platform, you agree to abide by these Terms. If you do not agree with any part of these Terms, please refrain from using the Treeboat Platform. Note that your access to Services, other platforms, or utilization of Products (as defined below) may also be subject to additional terms and conditions, policies, or guidelines (“Additional Terms”) along with these Terms. In the event of any inconsistency between these Terms and Additional Terms, the Additional Terms will take precedence concerning the relevant Service or Product use. These Terms govern your use of the Treeboat Platform and transactions thereon.

For the purposes of these Terms: (a) “Treeboat Platform” refers to the website www.treeboat.in, including its corresponding mobile applications, websites, tablets, desktops, or any other digital mode and/or operating system provided by us, through which you can access the Services. It includes applications controlled and managed by us that interact with one or more such mobile applications/websites/tablets and digital modes provided by us; (b) “Products” refers to furniture and other items available for purchase on the Treeboat Platform; (c) We and you are individually referred to as “Party” and collectively as “Parties.”

These Terms are divided into two parts. Please read all sections carefully to understand the conditions applicable to your use of the Treeboat Platform and the purchase of Products.

PART A – TERMS AND CONDITIONS FOR USAGE OF TREEBOAT

GENERAL 1.1 The terms and conditions for using the Treeboat Platform, as outlined herein (“Terms of Use”), specifically govern your access and use of the Treeboat Platform. This platform allows you to discover, select, and purchase Products listed at indicated prices from locations we service.

1.2 We may modify these Terms of Use from time to time. Please review them each time you use the Treeboat Platform to ensure you understand the current terms and conditions. We reserve the right to change the format and content of the Treeboat Platform or suspend its operation for maintenance or updates at any time.

1.3 Accessing, browsing, or using the Treeboat Platform signifies your agreement to these Terms of Use, the Treeboat Platform’s privacy policy, and any other applicable policies or guidelines (collectively, the “Agreement”).

1.4 This document is an electronic record under the Information Technology Act, 2000, and does not require physical or digital signatures.

1.5 We authorize you to view and access the Treeboat Platform solely for identifying Products, making purchases, and processing returns and refunds according to our Return and Refund Policy. This grants you a limited, revocable permission to use the Services.

1.6 By accepting this Agreement, you confirm that you are at least 18 years old and legally competent to enter into this Agreement. If you are under 18, you must use the Treeboat Platform under the supervision of a parent or legal guardian who agrees to these terms. If we learn a user is under 18 and not supervised, we reserve the right to deactivate their account without notice. If you are using the Services on behalf of a company or organization, you represent that you have the authority to act on their behalf and that the entity accepts this Agreement.

REGISTRATION OF YOUR ACCOUNT 2.1 To purchase Products and/or use Services, you may register on the Treeboat Platform or check out as a guest. Registration is a one-time process. After completing registration and receiving confirmation via email, you will have access to the Services.

2.2 You are responsible for operating your account and maintaining the confidentiality of your login credentials. You must also restrict access to your devices to prevent unauthorized account access. You are liable for all actions taken through your account.

2.3 You must immediately inform us of any unauthorized use of your account or security breaches and ensure you log out at the end of each session. We and our affiliates will not be liable for any loss or damage resulting from your failure to comply with these Terms of Use. You may be held liable for losses incurred by us or other users due to unauthorized use of your account. We reserve the right to refuse access, terminate accounts, and remove or edit content at any time without notice.

COMMUNICATION AND UNSUBSCRIPTION 3.1 By accepting these Terms, you agree to receive updates, offers, and promotional messages to the phone number you provided. By using the Treeboat Platform and verifying your contact number, you consent to receive such communications from us or our authorized representatives, even if your number is registered on the Do Not Disturb (DND) list.

3.2 You can unsubscribe from marketing communications and notifications at any time by following the instructions in such communications.

DISCLAIMER OF WARRANTIES, INACCURACIES, OR ERRORS 4.1 We strive to ensure that all information and recommendations provided on the Treeboat Platform are accurate. However, we do not guarantee the completeness or accuracy of this information.

4.2 You agree to make your own determination regarding the suitability of the information for your purposes before making any decisions. Use of the Treeboat Platform and its information is at your own risk. We are not liable for any loss, damage, or expense arising from your access to or reliance on the Treeboat Platform or linked third-party websites.

4.3 Visual representations of Products on the Treeboat Platform are for identification purposes only. While we make reasonable efforts to ensure accuracy, actual Products may vary from their representations.

4.4 We do not make any representation or warranty that use of the Treeboat Platform or Products will not infringe on any patents or other rights.

4.5 We do not provide warranties regarding: 4.5.1 Quality, suitability, accuracy, reliability, or performance of the Products or information on the Treeboat Platform; 4.5.2 Availability of Services at all times; 4.5.3 Uninterrupted operation of the Treeboat Platform or the absence of viruses or harmful components.

4.6 The Treeboat Platform and Services are provided on an “as is” and “where-is” basis without any warranties. We and any third parties providing materials or services to this site make no warranties, either express or implied.

4.7 To the extent permitted by law, we disclaim any liability for losses, damages, or other issues arising from the failure of performance or other issues with Products or Services.

AVAILABILITY AND ACCESSIBILITY OF TREEBOAT PLATFORM 5.1 We operate the Treeboat Platform from India and make no representation about its appropriateness or availability in other locations. If you access the platform from outside India, you are responsible for complying with local laws.

5.2 We offer Services tailored to specific regions. Services available in one region may differ from those in another. We may cancel or redirect orders based on regional availability and regulations.

5.3 Information on the Treeboat Platform may reference Products or Services not available in your country. Such references do not imply availability or intention to offer them in your location.

5.4 We monitor accounts to prevent fraud. Users engaging in fraudulent activities or using referral vouchers improperly may face legal action and be liable for recovery costs. We reserve the right to terminate accounts and cancel orders without liability.

THIRD-PARTY INTERACTIONS AND LINKS TO THIRD-PARTY SITES 6.1 When using the Treeboat Platform, you may interact with third parties or access their websites. Any such interactions or transactions are solely between you and the third party. We are not responsible for these third-party activities.

COPYRIGHTS IN SERVE CONTENT 7.1 The Treeboat Platform contains copyrighted material and intellectual property owned by us or licensed to us. All rights are retained.

7.2 You may use Treeboat Content only for personal use and as allowed under these Terms. You may not copy, distribute, or use the content for commercial purposes without our consent.

7.3 You are prohibited from copying, modifying, or distributing Treeboat Content or using it in ways not authorized by these Terms.

7.4 The license granted to you does not include rights to resell Products or use Treeboat Content for commercial purposes, collect and use product listings, or extract information for database creation.

TRADEMARKS All trademarks associated with us and our Products are trademarks or registered trademarks of us or our affiliates. They may not be used in connection with any non-affiliated products or services.

LICENSE AND USE OF YOUR CONTENT 9.1 By posting content on the Treeboat Platform, you grant us a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, distribute, and display such content.

9.2 We do not routinely monitor user posts but reserve the right to do so. We may report illegal activities to law enforcement authorities and cooperate in investigations.

9.3 You are responsible for your content and agree to indemnify us against any claims arising from your use of the platform or any breaches of law or rights.

9.4 We reserve the right to terminate access to the platform for breaches of these Terms. Upon termination, you must destroy any downloaded or printed materials.

USER WARRANTIES AND RESTRICTIONS 10.1 You represent that your use of the Treeboat Platform will comply with laws and regulations, and the information you provide is accurate and lawful. We may reject registration or cancel orders if the information is false or inaccurate.

10.2 You agree to use the Treeboat Platform responsibly, not to infringe on others' rights, and not to engage in unauthorized activities. You will be liable for any breaches or damages arising from your use of the platform.

10.3 You will not use the Treeboat Platform to transmit any harmful or unlawful content, or to interfere with the platform’s operation or security.

TERMINATION OF USE 11.1 We reserve the right to terminate your access to the Treeboat Platform or Services if you violate these Terms. We may also suspend or limit access due to technical issues or maintenance.

11.2 Upon termination, you must destroy any materials obtained from the Treeboat Platform and discontinue all use of the platform.

LIMITATION OF LIABILITY 12.1 Our liability for any claims arising from your use of the Treeboat Platform is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages.

12.2 We are not responsible for any issues arising from third-party content or links on the Treeboat Platform.

GOVERNING LAW 13.1 These Terms are governed by the laws of India. Any disputes will be resolved in the courts of New Delhi.

ENTIRE AGREEMENT 14.1 These Terms, together with any Additional Terms and policies, constitute the entire agreement between you and us regarding your use of the Treeboat Platform and the Services.

SEVERABILITY 15.1 If any provision of these Terms is deemed unenforceable, the remaining provisions will continue to apply.

FORCE MAJEURE 16.1 We are not liable for any delay or failure in performance due to circumstances beyond our control, including natural disasters, war, or technical failures.

PART B – TERMS AND CONDITIONS OF SALE ON TREEBOAT PLATFORM

The terms and conditions of sale set forth herein (“Terms of Sale”) constitute an agreement between us, Inserve India (“we”, “us”, or “our”), and you, the customer (“you” or “your”), and govern the terms and conditions on which you purchase Products from us through the Treeboat Platform. By placing an order for any Product or making a purchase through the Treeboat Platform, you expressly agree to be bound by these Terms of Sale.

These Terms of Sale are in addition to the Agreement. This electronic record is generated by a computer system and does not require physical or digital signatures.

OUR CONTRACT OF SALE 1.1 The listing and display of a Product on the Treeboat Platform is an invitation to you to make an offer to purchase such Product. The placement of an order on the Treeboat Platform constitutes your offer to buy the Product(s) from us.

1.2 Once you have placed an order for a Product, you will receive an email and/or mobile confirmation acknowledging receipt of your order (the “Order Confirmation”). This confirmation merely acknowledges that we have received your order and does not signify our acceptance of your offer.

1.3 We accept your offer and conclude the contract of sale for a Product when the Product is shipped or dispatched to you and an email and/or registered mobile confirmation is sent to you (the “Shipment Confirmation”). We reserve the right to refuse or cancel any order at our sole discretion before sending the Shipment Confirmation.

1.4 If your order is dispatched in multiple packages, you may receive separate Shipment Confirmations for each package. Each Shipment Confirmation will conclude a separate contract of sale for the Products specified in that Shipment Confirmation.

1.5 All communications from us will be sent to your registered mobile number and/or email address or such other contact details that you provide for the transaction. You are responsible for updating your contact details on the Treeboat Platform. We may also send notifications and reminders about scheduled deliveries. We will make every effort to provide prompt notifications, but we are not liable for any failure to send such communications.

1.6 Your contract is with us, and you confirm that the Product(s) ordered are for your personal use and not for resale or business purposes. We sell Products only in quantities typical for an average household.

1.7 All orders are subject to Product availability, our acceptance of your offer, and your adherence to these Terms of Sale.

1.8 You authorize us to make any necessary declarations to governmental authorities on your behalf, including confirming that the Products ordered are for personal, non-commercial use.

RETURN AND REFUND Please review our Return Policy and Refund Policy, which apply to Products sold by us.

PRODUCT AVAILABILITY We provide availability information for Products on the relevant webpage of the Treeboat Platform. Availability is subject to change and cannot be guaranteed. Dispatch estimates are not guaranteed. We will notify you by email and/or mobile SMS if any Products you ordered are unavailable or out of stock.

PRODUCT PRICING 4.1 All prices are listed in Indian Rupees and include all applicable taxes.

4.2 The price of Products in your shopping cart reflects the most recent price displayed on the Product’s information page. Prices may change between the time you place a Product in your cart and the time you place your order. The prices applicable at the time of order placement will be charged on the delivery date.

LICENSES You acknowledge that certain Products may require licenses or permissions under applicable laws. You are solely responsible for obtaining such licenses/permissions and complying with their terms.

TAXES You are responsible for payment of all fees, costs, and charges associated with the purchase of Products, including any applicable taxes.

ELIGIBILITY Only individuals who can enter into legally binding contracts under Indian law, i.e., those who are 18 years or older, of sound mind, and not disqualified by law, can use the Treeboat Platform and place orders. Minors (under 18 years) may only make purchases with parental or guardian involvement.

LIMITATION OF LIABILITY Our liability, if any, is limited to the amount charged to you for the Products related to the claim. We are not liable for business losses (including loss of profits, revenue, or goodwill) or any other indirect or consequential losses not reasonably foreseeable at the time the contract was formed.

AMENDMENTS We reserve the right to change our policies and these Terms of Sale at any time. You will be subject to the Terms of Sale in effect at the time you place an order, unless changes are required by law or government authority (in which case they will apply to orders previously placed). If any provision is deemed invalid or unenforceable, it will be severed, and the remaining provisions will remain in effect.

FORCE MAJEURE We are not responsible for delays or failures in performance due to causes beyond our reasonable control.

WAIVER No provision in these Terms of Sale will be deemed waived, and no breach excused, unless such waiver or consent is in writing and signed by us. Our consent to or waiver of a breach will not constitute consent to or waiver of any other breach.

GOVERNING LAW AND DISPUTE RESOLUTION These Terms of Sale and any transactions between you and us are governed by the laws of India, with exclusive jurisdiction granted to the courts of New Delhi.

MISCELLANEOUS 13.1 In addition to these Terms of Sale, you must comply with the terms and conditions of any third parties, such as bank offers or brand promotions, linked within the Treeboat Platform.

13.2 These Terms of Sale supersede all previous oral or written terms and conditions communicated to you by us for the purchase of Products.
